INTRODUCTION
1.1. www.spectrumvocals.com, referred to in this Terms and Conditions Agreement as “we”, “us”, “our”, “site”, or “website”, along with all products, data, and other materials contained on the site, are owned and/or exclusively licensed to SPECTRUM VOCALS SRL, Romania.
1.2. All products, digital goods, data, and materials related to the site are owned and/or exclusively licensed to www.spectrumvocals.com, and are referred to in this Agreement as “product/s”, “digital product/s”, “sample/s”, “sample pack/s”, or “pack/s.”
1.3. 1.3. By accessing and using our website or any of the materials contained on the site, you, the user, agree to be bound by the terms of this Agreement (referred to as “Terms”, “Conditions”, “Agreement”, or “T&C”).
1.4. This Terms and Conditions Agreement, along with the Privacy Policy, constitutes the entire agreement between you and us, and is governed by the terms specified herein.
1.5. The Terms and Conditions Agreement is accessible to all users at www.spectrumvocals.com/terms, free of charge.

PRICES, PAYMENTS AND REFUNDS
2.1. We reserve the right to set and modify the prices of our products at our discretion, with any price changes taking effect immediately, without prior notice.
2.2. Payments can be made using a valid credit or debit card issued in your name by any international bank.
2.3. The available payment method is online payment via bank transfer, processed by our third-party payment partner. For the most current information on payment options, please refer to our Privacy Policy page.
2.4. As a customer, you are entitled to request a refund or other form of remedy in accordance with applicable consumer protection laws. If the product does not conform to the quality of the advertised sample or model, you may be eligible for one of the following: a replacement product, a partial refund (price reduction), a full refund (contract cancellation), or other appropriate compensation, depending on the nature of the issue. We reserve the right to evaluate each case individually and determine the most suitable resolution.

LICENSE, USAGE AND COPYRIGHT
3.1. By purchasing our products, you are granted a SINGLE USER LICENSE to use the products in your own musical compositions, including but not limited to songs, soundtracks, videos, and radio programs. This license grants you the right to commercially use the product as part of your own work.
3.2. The license provided through the purchase is NON-TRANSFERABLE. You are prohibited from duplicating, copying, lending, reselling, leasing, or redistributing the product, in whole or in part, to any third party (person, company, website, or file-sharing platform) unless mixed with your own production.
3.3. You may use the purchased product in your own musical compositions, such as songs, soundtracks, videos, commercials, and radio programs, for both commercial and non-commercial purposes.
3.4.1. You are prohibited from creating new sound libraries by isolating portions of the product for resale or redistribution on other platforms, unless you have written permission from us. This includes selling or distributing any sample from the product as part of a new library or standalone sample pack.

OWNERSHIP OF CONTENT
4.1. Purchasing a product from our website grants you a license to use the product as described in Section 3, but does not transfer ownership.
4.2. All intellectual property rights, including ownership of the product, remain with Spectrum Vocals SRL or the respective rights holders.
4.3. You acknowledge that by purchasing, you do not gain any ownership, rights, or title to the product, except for the license to use it as specified in these Terms.

LIMITATION OF LIABILITY
5.1. Spectrum Vocals SRL is not liable for any direct or indirect damages, losses, or liabilities arising from the use of the website, products, or services provided, including but not limited to interruptions, technical failures, or issues related to the products.
5.2. While we take reasonable measures to protect our content and services, we are not responsible for any unauthorized access or misuse of your personal data or product files by third parties.

REVISION
6.1. We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion. Please review these Terms periodically for any changes.
6.2. Continued use of our website and services after any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must cease using our services.

APPLICABLE LAW
7.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Romania.
7.2. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Romania.

8. THIRD-PARTY SERVICES
8.1. We use third-party payment processors, such as Stripe, to handle transactions on our website. By purchasing, you agree to be bound by the third-party payment processor’s terms and privacy policies. We may share necessary payment details with these processors to complete your transaction.

9. DISPUTE RESOLUTION AND AMICABLE SETTLEMENT

If such efforts do not lead to a resolution, we agree that the dispute will be handled through an informal and mutually agreed-upon process, without resorting to formal legal proceedings, unless required by law.

10. FORCE MAJEURE
10.1. Neither party shall be liable for failure to fulfill any obligation under these Terms due to events beyond their reasonable control, including but not limited to natural disasters, governmental actions, or technological failures.
10.2. In the event of force majeure, the affected party shall promptly notify the other party.

11. FINAL CLAUSES
11.1. This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior discussions, representations, or agreements.
